REGRESSIVE CLAIM AGAINST THE PERPETRATOR OF THE ACCIDENT!
MTIBU has the right to file a recourse claim after payment of insurance indemnity:
to the owner, the driver of the vehicle who caused the accident, who did not insure his civil liability, except for the persons specified in paragraph 13.1 of Article 13 of the Law;
to the driver of the vehicle who took possession of the vehicle by illegal means;
to the insurer, if the insured vehicle that caused the damage was identified and the insurer was obliged but did not pay the insurance indemnity in the manner prescribed by this Law;
to the enterprise, institution, organization responsible for the condition of the road, if the damage caused by a traffic accident occurred through their fault;
to a person specified in paragraph 13.1 of Article 13 of the Law, who is involved in a traffic accident, if he drove a vehicle in a state of alcohol, drugs or other intoxication or under the influence of drugs that reduce attention and speed of reaction, and if she has refused to undergo an examination in accordance with the established procedure for alcohol, drug or other intoxication or for the use of drugs that reduce attention and speed of reaction, and / or has used alcohol, drugs or drugs based on them (except those that are part of the officially approved first aid kit or appointed by a medical professional), and / or she drove a vehicle without the right to drive a vehicle of the appropriate category, and / or left the scene of the accident.
